RESIDENCY
REQUIREMENTS:
Either spouse
must be a resident of Maine for 6 months prior to the filing of
the complaint.
GROUNDS
No-Fault:
Irreconcilable marital differences.
Impotence;
Adultery;
Alcoholism
and/or drug addiction;
Confinement
for incurable insanity for 7 consecutive years;
Desertion
for 3 years;
Cruelty
or abuse;
Nonsupport
whereby a spouse is able to provide support but grossly, wantonly,
or cruelly refuses or neglects to provide suitable maintenance for
the complaining spouse.
LEGAL
SEPARATION:
A legal
separation will be granted if both spouses desire to live separate
and apart for more than 60 days. If the parties have minor children,
mediation between the parties is mandatory.
SIMPLIFIED
DIVORCE
If both
parties are in agreement, an Affidavit of Corroborating Witness
is not needed and both parties can sign a Marital Settlement Agreement.
PROPERTY
DISTRIBUTION:
If the parties
do not agree to a division of property, the court will decide how
the property will be divided based on equitible distribution without
regards to fault.
CHILD
ISSUES
Parties
may agree to joint or sole custody. If the parties cannot agree
on custody, the court will decide what is in the children's best
interest.
Maine has
state child support guidelines which will be used when determining
child support. The parties may agree but if they cannot agree on
an amount for child support, the court will decide using these state
guidelines.
